Musk vs OpenAI: Sixth Lawsuit Signals Escalating AI Feud

“Enough is enough.” With this blunt declaration on X, Elon Musk has once again taken aim at OpenAI—the very company he helped to create. Last week, his AI startup xAI filed its sixth lawsuit in just 18 months against OpenAI, this time in a federal court in Northern California.

The new lawsuit accuses OpenAI of systematic and deliberate employee poaching, alleging that the company lured away xAI’s key engineers and executives in order to steal trade secrets—including the source code of xAI’s Grok large language model and sensitive data center strategies.

This marks a dramatic escalation from earlier complaints of contract breaches and unfair competition, to accusations of outright theft of intellectual property. The legal battles highlight how the rivalry between Musk and OpenAI’s CEO Sam Altman has entered a boiling point—not just in product competition, but now in the courtroom.

1. Alleged Theft of Trade Secrets

According to court filings, xAI claims OpenAI pursued a “deeply troubling pattern” of targeting core employees, deliberately inducing them to break confidentiality agreements in order to gain access to source code, operational insights, and business strategies.

Musk himself vented on X:

“We sent multiple warning letters, but they continued deceiving and cheating. After trying every other option, a lawsuit was our only choice.”

OpenAI, however, categorically denies wrongdoing. The company called the case nothing more than “Musk’s ongoing harassment” and a self-serving attempt to prop up his own AI venture.

Still, xAI named three specific former employees as examples: engineers Xuechen Li and Jimmy Fraiture, who allegedly copied core Grok code, and a former senior executive—believed to be ex-CFO Mike Liberatore—who was accused of leaking data center strategy plans.

2. Downloading the Entire Codebase

The lawsuit builds on an earlier case in August, when xAI accused Li of copying confidential files just days before leaving. According to filings, on July 25, Li allegedly downloaded xAI’s entire codebase to his personal devices, then cashed out $7 million in stock before resigning. Three days later, he joined OpenAI.

Musk fumed online:

“The logs prove it—he downloaded everything before leaving. He even admitted it!”

A California court has already issued a temporary restraining order barring Li from working at OpenAI—or any AI firm—until the October 7 hearing. He has also been ordered to surrender all personal devices and cloud accounts for forensic investigation.

Fraiture, another engineer, is accused of similarly copying Grok chatbot files before defecting to OpenAI. Meanwhile, Liberatore allegedly dismissed xAI’s legal warning with a profanity-laced email before joining OpenAI.

3. The Data Center Showdown

At the heart of the dispute lies xAI’s planned supercomputing hub in Tennessee, which Musk says could run on 100,000 of Nvidia’s cutting-edge GPUs. This cluster would form one of the world’s most powerful AI supercomputers—directly rivaling OpenAI’s own partnership with Nvidia, backed by a $100 billion investment.

In its lawsuit, xAI claims OpenAI “stooped to plundering xAI’s innovations” because its Grok model—particularly the newly launched Grok-4—was matching or even surpassing OpenAI’s flagship models, threatening its market dominance.

The case will now proceed into a discovery phase involving witness testimony and evidence exchanges. xAI may seek injunctions to bar OpenAI from using any disputed technology—or even from employing certain former xAI staff.

4. Legal and Industry Stakes

The outcome could reshape the AI battlefield. If xAI proves its claims, OpenAI could face billions in damages, restrictions on hiring, and reputational fallout with key partners such as Apple and Microsoft. For xAI, a victory would mean safeguarding its technical edge and stopping further talent drain.

Yet legal veterans note that such high-stakes cases often end in out-of-court settlements, with compensation payments and non-poaching agreements. The real question: does Musk want money—or revenge?

5. A Silicon Valley Pattern

While non-compete clauses are unenforceable in California, employees are still legally bound by confidentiality agreements. Copying code or business plans remains illegal, no matter who developed them.

This is hardly new in Silicon Valley: Google, Apple, and Tesla have all sued former staff for trade-secret theft in recent years. Some cases ended in settlements; others, like Google’s Anthony Levandowski saga, ended in prison time.

In Musk’s case, the legal war also doubles as a personal grudge match. Once close collaborators, Musk and Altman are now bitter rivals, trading public jabs while fighting in court.

6. Six Lawsuits in 18 Months

Musk co-founded OpenAI in 2015, pledging $1 billion to fund non-profit AI research. But after clashing with the board over leadership and strategy, he left in 2018. OpenAI later pivoted to a for-profit model, securing billions from Microsoft, and releasing ChatGPT to global acclaim—moves Musk sees as a betrayal of the original mission.

Since February 2024, Musk has filed six lawsuits against OpenAI, escalating from breach of mission and antitrust claims to employee poaching and trade-secret theft:

1. Feb 2024 – Accused OpenAI of becoming a “closed-source subsidiary of Microsoft,” betraying its non-profit roots.
2. Aug 2024 – Expanded lawsuit to include Microsoft, alleging monopolistic practices.

4. Mar 2025 – Attempted to block OpenAI’s profit conversion; later dismissed.
5. Aug 2025 – Sued Apple and OpenAI for antitrust, claiming App Store bias against xAI and Musk’s platforms.
6. Sep 2025 – Current case: Accusing OpenAI of poaching talent and stealing trade secrets.

As Altman put it in a recent rebuttal:

“Considering Musk’s long history of manipulating systems for his own benefit, his accusations are absurd.”

Their once-close partnership has now collapsed into one of the most bitter feuds in tech.
